Terms of Service
By creating a Selge account or using the Service, you agree to these terms. Please read them carefully.
1. Parties and definitions
These Terms of Service (“Terms”) constitute a legally binding agreement between [OPERATOR_FULL_NAME], [OPERATOR_STREET_ADDRESS], [POSTAL_CODE] [CITY], Germany (“Selge”, “we”, “our”, “us”) and the person or entity that registers for and uses the Selge service (“Customer”, “you”, “your”).
In these Terms:
- Service — The Selge web application, dashboard, API, embeddable survey widget, and any associated tools available at selge.app.
- Widget — The embeddable JavaScript snippet you install on your website to run surveys.
- Survey Data — Responses collected from your website visitors via the Widget.
- Account — Your Selge user account and associated projects.
2. The Service
Selge provides an on-site micro-survey tool that lets you embed short surveys on your website to collect feedback from your visitors. The Service includes the dashboard, the embeddable Widget, the API, and any AI-powered features.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. If we discontinue the Service entirely, we will give you at least 60 days notice and provide a mechanism to export your data.
3. Accounts and eligibility
To use the Service you must:
- Be at least 18 years old or the age of legal majority in your jurisdiction.
- Be a legal person (individual or company) capable of entering a binding contract.
- Provide accurate and complete registration information.
- Keep your account credentials confidential and notify us immediately of any unauthorized access.
You are responsible for all activity that occurs under your account. One account may not be shared between multiple individuals unless you are purchasing on behalf of a team within a single organization.
4. Acceptable use
You agree not to use the Service to:
- Collect personal data from minors without appropriate parental consent.
- Run surveys that are deceptive, misleading, or designed to manipulate respondents.
- Collect sensitive personal data (health, financial, political opinions, biometrics) without a lawful basis and appropriate disclosures to respondents.
- Violate any applicable law or regulation, including GDPR, CAN-SPAM, or consumer protection laws.
- Reverse-engineer, decompile, or attempt to extract the source code of the Widget or Service.
- Resell, sublicense, or white-label the Service without our prior written consent.
- Use the Service to send spam, run phishing surveys, or otherwise harm website visitors.
- Circumvent any rate limits, usage caps, or technical restrictions of the Service.
- Use the Service in a way that materially degrades performance for other customers.
We may suspend or terminate accounts that violate these rules without prior notice.
5. Subscriptions and billing
Selge offers a free account (no active surveys) and paid subscription plans. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.
Subscriptions are billed monthly or annually in advance. Annual plans are charged as a single upfront payment.
We will give you at least 30 days notice of any price increase. The new price applies from your next renewal date.
Prices are exclusive of VAT. EU VAT is calculated and collected at checkout via Stripe Tax. You are responsible for any other applicable taxes.
If a payment fails, we will retry up to 3 times over 7 days. If payment is not recovered, your account will be downgraded to the free plan and active surveys will be paused.

Response limits apply per project per month (500 on Starter, 5,000 on Pro). When a project reaches its limit, the active survey is automatically paused until the next billing cycle. Unused responses do not roll over.
6. Cancellation and termination
You may cancel your subscription at any time from the Billing section of your dashboard. Cancellation takes effect at the end of your current billing period. You retain full access to the Service until that date.
After cancellation, your account reverts to the free plan. Your surveys are paused and your data (projects, surveys, responses) is retained for 90 days. You may resubscribe at any time to restore access. After 90 days, data is permanently deleted.
We may terminate your account immediately and without refund if you breach these Terms, engage in fraudulent activity, or if required by law. In non-urgent cases we will give you 14 days notice and an opportunity to remedy the breach.
If we close the Service, we will provide at least 60 days notice, a prorated refund for unused prepaid subscription time, and a data export mechanism.
7. Your data
You own your data. Survey Data (responses collected from your visitors) belongs to you. We process it on your behalf as a data processor under our Data Processing Agreement.
You represent and warrant that you have a lawful basis to collect the Survey Data you collect via the Widget, and that you have made appropriate disclosures to your website visitors. You are the data controller for Survey Data under GDPR. We are the data controller only for your account and billing data.
We will not sell, rent, or share your Survey Data with third parties, except as required by law or as set out in our Privacy Policy and DPA.
You may export your Survey Data at any time via CSV export in the dashboard. Upon account deletion, all data is permanently deleted within 30 days (except invoicing records retained for tax compliance).
8. Intellectual property
The Service, including all software, design, branding, templates, and documentation, is owned by us and protected by copyright and other intellectual property laws. These Terms do not transfer any ownership to you.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service during your subscription, solely for your internal business purposes in accordance with these Terms.
You grant us a limited licence to host, store, and process your Survey Data and account content solely to provide the Service to you.
The Selge name, logo, and “Powered by Selge” badge are our trademarks. You may not remove or obscure the badge on surveys on free accounts. On paid plans, badge removal is available in settings.
9. Limitation of liability
To the maximum extent permitted by applicable law, our total aggregate liability to you for any claims arising out of or related to the Service or these Terms is limited to the greater of:
- The amount you paid to us in the 12 months preceding the claim, or
- EUR 100.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, loss of goodwill, or business interruption, even if we have been advised of the possibility of such damages.
Note: Some jurisdictions (including certain EU member states) do not allow limitations on implied warranties or consequential damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
We target 99.5% monthly uptime for the dashboard. The Widget (served from your visitors’ browsers) is designed to fail silently and will never break your website if the Service is unavailable. Scheduled maintenance is excluded from uptime calculations. No formal SLA applies on Starter and Pro plans.
11. Indemnification
You agree to indemnify, defend, and hold harmless Selge and its operator from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms.
- Your violation of any law or third-party rights.
- Survey Data you collect in violation of applicable privacy laws.
- Content you include in your surveys that infringes third-party intellectual property.
12. Governing law and disputes
These Terms are governed by the laws of Germany, excluding its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
For customers who are consumers resident in the EU, the mandatory consumer protection laws of your country of residence apply in addition to German law, and you may bring proceedings in the courts of your country of residence.
For business customers, any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [CITY], Germany.

13. Changes to these terms
We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the new terms take effect. For minor changes (typos, clarifications, reorganisation without substantive changes), we will update the “Last updated” date and the new terms take effect immediately.
Continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you may cancel your subscription before they take effect.
